The petitioners seek bail in Giriyak (Katrisarai) P. S. Case No. 364 of 2019 instituted for the offence under Section(s) 419,420,467,438,471 of the Indian Penal Code and Section 66 of the Information Technology Act.

The petitioners are stated to be in custody since 21.10.2019. The accusation against the petitioners is only on the basis of suspicion. They appear to have been arrested along with others while trying to impress upon investors with false

It has been submitted on behalf of the petitioners that the accusation, therefore, is only on the basis of suspicion and there is no complaint against them by anyone of the villagers or persons who were contacted by them or their associates. It is further pointed out that similarly situated co-accused of instant case has also been allowed the privilege of bail by co-ordinate Bench of this Court vide order dated 03.12.2019 passed in Cr. Misc. No. 78554 of 2019.

The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM, Nalanda, in connection with Giriyak (Katrisarai) P. S. Case No. 364 of 2019 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(ii) That the petitioners will be well represented on each
