The petitioner is apprehending his arrest in connection with Araria Mahila P.S.Case No.61 of 2017 registered for offences punishable under Section 376 of the Indian Penal Code. Allegation against the petitioner is of committing rape upon the informant on the assurance of marriage and she became pregnant also.

Submission of the learned counsel for the petitioner is that now the compromise has been reached between the parties and they have married also and she is living along with the petitioner. Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before

No.23224 of 2018 (2) dt.19-04-2018 2/2 the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail before the learned trial court who will examine the submissions of the learned counsel for the petitioner that both the parties are married to each other and living together and after examining the same he will dispose of the prayer for bail of the petitioner without being prejudiced by the order of this Court.
