2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code.
3. As per the FIR, the allegation against the petitioner is that he along with other co-accused persons cheated the informant as a sum of Rs. 8,20,000/- to get consignment of rice.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that it is a business dispute between the parties. There is no specific allegation against the petitioner . The petitioner has clean antecedent.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.1561 of 2024(2) dt.08-02-2024 2/2 bail.
6. Considering the facts and circumstance of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sadar P.S. Case No. 793 od 2023 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) N.K/- U T
