JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with NDPS Case No. 79 of 2017, arising out of Ramgarhwa P.S. Case No. 214 of 2017 for the offenses under Sections 20(b) (ii), 22 and 23 N.D.P.S. Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and and he is in custody since 16.10.2017. Counsel further submits that on the date of alleged occurrence the petitioner was on way to his examination for selection of constable at R.K.High School, Bettiah, West Champaran.

Considering the fact that the petitioner has no criminal

No.28314 of 2018(4) dt.05-07-2018 2/2 antecedent and he has remained in jail for nearly nine months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum- Special Judge, East Champaran, Motihari in connection with NDPS Case No. 79 of 2017, arising out of Ramgarhwa P.S. Case No. 214 of 2017.
