====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-04-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends her arrest in connection with Makhdumpur (Tehta) P.S. Case No. 45 of 2018 registered under Section 366(A)/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. In fact, she had no knowledge about the affairs of her son and the daughter of informant. It is also submitted that on perusal of Supplementary Affidavit, it appears that on the alleged date of occurrence, daughter of the victim was major. Son of the petitioner and daughter of the informant have already solemnized marriage at Rajgir and to that effect, both have filed an affidavit (Annexure-4 to the
Patna High Court Cr.Misc. No.24624 of 2018(2) dt.30-04-2018 2/2 supplementary affidavit).
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jehanabad in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 45 of 2018, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
