Petitioner, already in custody, seeks bail in connection with Motihari Town PS Case No.178 of 2014, giving rise to Sessions Trial No.173 of 2017, registered under Sections 307, 341, 323, 325, 379, 382, 504 and 506/34 of the Indian Penal Code.

Allegation in brief is that the petitioner along with others assaulted the informant as he was not acceding to demand of extortion.

Learned counsel for the petitioner submits that the allegation is false and fabricated and injury found on the person of the informant are simple in nature and during trial in the

No.24902 of 2018(2) dt.26-04-2018 2/2 present case the informant in his deposition has stated that altercation took place on the festival of Holi and petitioner has remained in custody for approximately two years. Having considered the aforesaid facts and circumstances, petitioner Rahul Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 12th Additional Sessions Judge, Motihari, District East Champaran in connection with Motihari Town PS Case No.178 of 2014, giving rise to Sessions Trial No.173 of 2017.
