JUSTICE ALOK KUMAR SINHA ORAL ORDER 17-12-2025 Heard learned counsel for the petitioner, learned counsel appearing for the respondent-State and learned counsel appearing for the respondent- B. N. Mandal University.

2. With the consent of the parties, the present writ application is being disposed of at the stage itself.

3. In the present writ application, the petitioner has prayed for grant of the following relief(s):- "For issuance of writ in the nature of Mandamus commanding Respondents to pay 25% of the remuneration of the period

Patna High Court CWJC No.20346 of 2025(2) dt.17-12-2025 2/3 August, 1998 to July, 2018, arrear of salary from August, 2018 to October, 2025 and till date."

After advancing some arguments, learned counsel for the petitioner submits that for claiming the aforesaid relief, the petitioner has already filed a representation dated 08.09.2025 before the Director, Higher Education, Education Department, Govt. of Bihar, Patna and the same continues to be pending.

5. He, therefore, prays that an appropriate direction be issued to the Director, Higher Education, Education Department, Govt. of Bihar, Patna to dispose of the pending representation of the petitioner within a fixed period of time after giving an opportunity of hearing to he petitioner.

6. To the aforesaid submissions made by learned counsel for the petitioner, learned counsel appearing for the respondents-University and the State does not have any objection.

7. Considering the limited nature of prayer made by learned counsel for the petitioner, this writ application is disposed of directing the Director, Higher Education, Education Department, Govt. of Bihar, Patna to dispose of the pending representation of the petitioner within a period of two months

Patna High Court CWJC No.20346 of 2025(2) dt.17-12-2025 3/3 from the date of receipt/production of a copy of this order, after giving an opportunity of hearing to the petitioner. In case, the petitioner is found entitled to the monetary benefits being claimed by the petitioner, then the Director, Higher Edcuation, Education Department, Govt. of Bihar, Patna shall make payment of the same to the petitioner within a period of three months after final order has been passed.

8. Needless to emphasize that the final order which shall be passed by the Director, Higher Education, Education Department, Govt. of Bihar, Patna, should be a reasoned and speaking order.

9. With the aforesaid observation and direction, the present writ application stands disposed of.

10. Pending Interlocutory Application, if any, stands disposed of.
