In this case, the petitioner is apprehending his arrest in connection with Kotwali (Gaya) P.S. Case No. 98 of 2017 registered for offences under sections 379 of the Indian Penal Code and Section 411 of the Indian Penal Code added later.
In the present case, the Informant had parked his motorcycle near the Union Bank. After ten minutes, when he returned, the motorcycle was missing.
The name of the present petitioner has come in the confessional statement of the accused Golu Kumar from whose possession, the alleged stolen motorcycle was recovered. Looking to the entire facts and circumstances of the
Patna High Court Cr.Misc. No.30345 of 2018(2) dt.18-05-2018 2/2 case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
