The petitioner apprehends his arrest in RC 2A/16 (Special Case No.1/2017) registered under Sections 420, 120(B) of the Indian Penal Code and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988. The petitioner is alleged to have defalcated a sum of Rs.41, 50, 000/- being Branch Manager of Central Bank of India, Chhatouna Branch, Begusarai.

Learned counsel for the petitioner submits that from perusal of final report at Page 32, it would appear that the C.B.I. found no case against the petitioner true and recommended for

Patna High Court Cr.Misc. No.26005 of 2018 (2) dt.04-05-2018 2/2 departmental enquiry as the petitioner was found violating different circulars of the bank.

Mr. Bipin Kumar Sinha, learned counsel for the C.B.I. has not disputed the fact.

Considering the aforesaid fact that C.B.I. after inquiry, found allegation of defalcation against the petitioner false and recommended for departmental proceeding in view of the violation of circulars of the bank, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, C.B.I.-1, Patna in RC 2A/16 (Special Case No.1/2017) subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
