JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-12-2019 This Criminal Writ application has been filed for seeking direction upon the respondents to release of the sale deed dated 22.01.2011 related with the petitioner detailed in Serial No.36 of the seizure list prepared by the Economic Offences Unit.

Learned counsel for the petitioner has submitted that the petitioner field a petition before the Special Judge Vigilance-I -cum- Authorized Officer, Patna on 01.08.2018 for release of the sale deed No. 1615 dated 22.01.2011 which is executed in favour of the petitioner, which is evident from Annexure-2. Further, a supplementary petition

Patna High Court CR. WJC No.1819 of 2019(2) dt.19-12-2019 2/2 dated 13.09.2018 has also been filed by the petitioner for release of the deed in question, which is evident from Annexure-3. Moreover, the respondent in their rejoinder has specifically mentioned that the property described in the deed in question has not been mentioned in the Charge sheet, which is evident from Annexure-4 and neither the same is required for further trial nor the property described in the deed in question is not included in confiscation proceeding. Therefore, the petitioner seeks proper direction to the concerned to release the deed in question. In view of the aforesaid fact, this Court deems fit proper to direct the Special Judge Vigilance -I -cumAuthorized Officer, Patna to dispose of the petition for release of the deed in question filed by the petitioner in accordance with law.

With the aforesaid observation, this Criminal Writ application is disposed of accordingly.
