2. The petitioner seeks bail in a case registered for the offence punishable under Sections 303(2), 62, 109, 3(5) of the B.N.S. and Sections 25(1-B) (a), 26, 27, 35 of the Arms Act.

3. Petitioner along with other accused persons are said to have tried theft the buffalo of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that nothing has been recovered from the conscious possession of the petitioner. He submits that no such occurrence has ever been taken place. He further submits that petitioner has five criminal antecedents as stated in para-3 of the bail application and he is languishing in judicial custody since 20.08.2024.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail after framing of charge on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mokama P.S. Case No. 353 of 2024.
