2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 356/379 of the Indian Penal Code.

3. As per allegation in the FIR, while the informant was sitting in tempo with a bag containing Rs. 1,68,000/- two miscreants on a motorcycle came there and snatched his bag and fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather he was arrested in Biraul P.s. Case No. 513 of 2022 in which his confession was recorded and on the basis of which, he has falsely been

Patna High Court CR. MISC. No.12422 of 2024(3) dt.15-05-2024 2/2 implicated in this case. The petitioner has not been put on TI Parade. It is further submitted that the petitioner is languishing in judicial custody since 8.2.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail after framing of charge, if not framed in connection with Biraul P.S. Case No. 445 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Biraul or concerned court.
