JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sasaram Agrer P.S. Case No. 1988 of 2017 dated 31.12.2017 instituted for the offences under Sections 379, 411 of the Indian Penal Code and Section 11 of the Prevention of Cruelty to Animals Act, 1960.

A pick-up van with 19 calves of buffalo was intercepted.

The petitioner is not named in the F.I.R and he has been implicated in this case because he happens to be the owner of the aforesaid pick-up van.

The learned counsel for the petitioner has submitted that assuming but not admitting that the pick-up van of the petitioner was used for transporting the animals, that by

Patna High Court Cr.Misc. No.25555 of 2018 (2) dt.03-05-2018 2/2 itself will not attract the mischief of the offence under Sections 379, 411 I.P.C or Section 11 of the Prevention of Cruelty to Animals Act, 1960. One out of the two arrested accused persons has been granted bail by the learned Court below.

The petitioner does not bear any criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram at Rohtas in connection with Sasaram Agrer P.S. Case No. 1988 of 2017.
