JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 2607c/2018, disclosing offence under Section 420 of the Indian Penal Code. As per prosecution case, petitioner entered into an agreement to sell of his land to the complainant and taken Rs. 1,50,000/- and on assurance, further payment of Rs.50,000/-, the sale deed will be executed, but later on, he failed to execute the sale deed.
Submission of learned counsel for the petitioner is that except oral allegation, there is no any document to show payment being made for the purchase of the land to the petitioner and allegation is in the nature of civil dispute.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Judicial Magistrate-I, Class, Araria, in connection with complaint case No. 2607c/2018.
