JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-01-2020 The petitioner seeks regular bail in connection with Ram Krishna Nagar P.S. Case No. 497 of 2019, registered for offences punishable under Sections 413, 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Allegation against the petitioner is of recovery of stolen motorcycle and scooty as well as two litres of liquor from the house of the petitioner. Apart from that it appears that petitioner is accused in three more cases.

It has been submitted on behalf of the petitioner that in this case whole family members have falsely been made accused and mother of the petitioner has already been enlarged on bail and petitioner has been in judicial custody since 25.10.2019.

Patna High Court CR. MISC. No.3631 of 2020(2) dt.21-01-2020 2/2 Learned counsel for the State opposed the prayer for bail.

Having heard both sides, considering the facts and circumstances as well as the criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail. However, once charge is framed in this case, the petitioner will be at liberty to renew his prayer for bail. This application is accordingly dismissed.
