2. The petitioner seeks bail in connection with Chhatauni P.S.Case No. 517 of 2023 registered for the offence punishable under Sections 394, 414, 120B of the Indian Penal Code and Section 25 (1-b) a, 9, 26, 35 of the Arms Act.

3. The petitioner and others were caught by the police. There is recovery of one country made pistol and two cartridges.

4. Learned counsel for the petitioner submits that petitioner is in custody since 15.10.2023, having clean antecedent.

5. Considering the facts and circumstance of the case, this application is allowed, let the above named, petitioner is

Patna High Court CR. MISC. No.3474 of 2024(3) dt.09-04-2024 2/2 directed to be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Chhatauni P.S.Case No. 517 of 2023.

6. This is also subject to the conditions that the petitioner shall mark his attendance in Kesariya Police Station on first Sunday of every month and co-operate in the trial. If he fails to do so, the bail bonds of the petitioner shall be cancelled. (Sandeep Kumar, J) N.K/- U T
