The petitioner seeks bail in connection with Special Case No. 882 of 2018 arising out of Kankarbagh P.R. PS Case No. 307 of 2018 for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the informant is that on secret information, the police officials raided a thatched hut and the petitioner was found fleeing away. 30 litres of country made liquor was recovered from the hut and the petitioner was apprehended.

It has been submitted by the learned counsel for the

Patna High Court Cr.Misc. No.27668 of 2018 (2) dt.10-05-2018 petitioner that he is innocent, bears no criminal history, nothing has been recovered from his conscious possession and that he is languishing in jail since 02-02-2018.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and materials on record, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousands) each, with two sureties of the like amount each to the satisfaction of learned Special Court, Excise, Patna in connection with Special Case No. 882 of 2018 arising out of Kankarbagh P.R. PS Case No. 307 of 2018.
