1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Bhabua P.S. Case no.931 of 2023 registered under sections 379 and 411 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the motorcycle which he had parked while going to his agricultural field was stolen by unknown accused persons.

4. Learned counsel for the petitioner submits that the F.I.R. was registered against unknown. Referring to the order of the learned Court below, it is submitted that allegedly the motorcycle was recovered from the house of the petitioner. Further, in reference to the seizure list, it is submitted that the seizure list (Annexure-2) does not inspire confidence in so far as

Patna High Court CR. MISC. No.194 of 2024(2) dt.24-01-2024 2/2 the witnesses to the seizure list are not even residents of nearby place to the place of seizure. The petitioner is in custody since 17.10.2023, has no criminal antecedent and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner, chargesheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Bhabua P.S. Case no.931 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhabua (Kaimur).
