Petitioner, already in custody, seeks bail in connection with Narpatganj PS Case No.71 of 2018, registered under Sections 399/402/353/307 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that the police apprehended three persons, said to have been making plan for committing dacoity and a country made loaded pistol was recovered from another co-accused and one live cartridge from possession of the petitioner.
Learned counsel for the petitioner submits that the petitioner before lodging the present case had no criminal antecedent, only subsequent to this case arising out of the
Patna High Court Cr.Misc. No.25961 of 2018(2) dt.02-05-2018 2/2 present one, one case under the Arms Act too was lodged regarding recovery of one live cartridge and the petitioner is in custody since 23.02.2018.
However, considering the aforesaid facts and circumstances, petitioner Bharat Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj PS Case No.71 of 2018.
