2. The present petition has been preferred for: "for modification of the oral order dated 23/07/2024 passed in CWJC No. 10381 of

Patna High Court MJC No.4513 of 2024(6) dt.08-08-2025 2/3 2023 by this Court to the extent that till the Bihar State Religious Trust Board constitutes permanent committee the petitioner be permitted to function as the savait of the Radha Krishna Ji Mandir situated at village Tulsipur, P.S. Kharik, District Bhagalpur as per the wishes of the trustee."

A show cause has come on behalf of 'the Board' according to which, they are moving towards creation of permanent committee and request has been made to the concerned officers and in continuation of that, the letter issued by the Collector, Bhagalpur dated 11.12.2024 has been annexed to show that once the recommendation comes, the decision shall be taken.

4. Learned counsel for the petitioner has pointed out that the letter is dated 11.12.2024, we are in the month of August, 2025 and it is high time that they take decision and/or ask the Collector, Bhagalpur to immediately send recommendation.

5. The submission seems to be justified. 'The Board' cannot hide behind a letter issued in the month of December, 2024. It has to follow the order in toto and take immediate

Patna High Court MJC No.4513 of 2024(6) dt.08-08-2025 3/3 steps for constituting a permanent committee.

6. The petitioner, if eligible, can very well submit its application before the Collector, Bhagalpur, if not submitted and if the recommendation has still not been made.

7. The present petition (MJC No. 4513 of 2024) stands disposed of.
