Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offenses Act, 2012.
The FIR relates to kidnapping of the daughter of the informant. The victim in her statement under Section 164 Cr.P.C. has alleged kidnapping by the petitioner and others for ransom.
However, contention of the petitioner is that different photographs and love letters written by the victim to the petitioner and enclosed with the supplementary affidavit would reveal that the matter is of love affairs and under pressure of the
Patna High Court Cr.Misc. No.25779 of 2018 (3) dt.16-07-2018 2/2 parents, false statement was given under Section 164 Cr.P.C. Petitioner is in custody since 27.11.2017.
Finding substance in the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Town Police Station Case No. 835 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
