Counsel for the petitioner submits that her complain regarding selection of Anganwari Sevika in Ward No. 1 of Sakhwa Panchayat is pending before the District Magistrate, Samastipur. Copy of the representation is Annexure 9. The same however does not bear any receiving of the authority. Submission is that the same was sent by speed post and that the Collector had also directed the authorities concerned to look into the complain, however
Patna High Court CWJC No.25304 of 2019(2) dt.06-02-2020 2/2 no action has been taken on the said complain till date. Since the issue is pending consideration before the District Magistrate, no adjudication is required in the instant case and keeping the writ petition pending would be futile. The writ petition is disposed of with a direction to the District Magistrate, Samastipur (respondent No. 3) to take final decision on petitioner's pending claim in accordance with law expeditiously and without any undue delay.
