====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-12-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., co-accused Lalu Yadav, Laxmi Yadav, Pramod Yadav, Vijay Yadav and Uday Yadav are alleged to have assaulted one Yogendra Yadav, as a result of which, he succumbed to the injuries.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. As per F.I.R., five persons are alleged to have assaulted the deceased

Patna High Court CR. MISC. No.86083 of 2025(2) dt.17-12-2025 2/2 but as per post-mortem report, only one injury was found on the person of deceased which itself falsifies the prosecution story. Allegation of assault is general and omnibus and there is no specific allegation of overt act against these petitioners. Petitioners are ladies and claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, post-mortem report and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Darbhanga in connection with Baheri P. S. Case No. 31 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
