The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420, 120(B) of the IPC and 7 of the E.C. Act.

Allegedly, a truck loaded with 423 bags of rice has been seized by the police and suspicion is raised that the same was brought for black marketing.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case merely on suspicion. Petitioner is the owner of the said truck and on that basis, he has been made accused in this case. The real fact is that the proprietor of Om Traders has loaded the seized rice weighing

Patna High Court CR. MISC. No.1494 of 2024(2) dt.07-02-2024 2/2 211.50 quintal on the Truck of the petitioner. The petitioner is not at all concerned with the business of Om Traders and he is not a P.D.S. Dealer, therefore, offence under E.C. Act is not made out against the petitioner. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, since there is no specific allegation against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Madhepur P.S. Case No.236 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) pallavi/- U T
