The petitioners apprehend their arrest in connection with Madhepura P.S. Case No.598 of 2022 instituted for the offences punishable under Sections 341, 323, 385, 384, 427, 379, 120B, 504 and 506/34 of the Indian Penal Code. As per allegation in the FIR, alleged land dispute and demand of Rs.10,00,000/- and taking away a generator of Rs.35,000/- of the informant by the accused persons including the petitioners.

Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.590 of 2024(2) dt.29-01-2024 2/3 petitioners have falsely been implicated in this case. He further submits that there is land dispute between the parties and no demand was made by the petitioners.

However, learned APP for the State opposes the prayer for anticipatory bail of the petitioners. On perusal of the FIR, it appears that all offences are bailable except under Section 384 and 379 of the Indian Penal Code and also two criminal antecedent of the petitioner no.1 as mentioned in para-3 of the petition. One of the co-accused, namely, Chandani Devi has already been granted anticipatory bail by learned Additional District & Sessions Judge-I-cumSpecial Judge, Madhepura in ABP No.668 of 2023 vide order dated 17.10.2023.

Having considered the facts and circumstances of the case and submission of learned counsel for the parties, in the event of their arrest or surrender before the Court below within six weeks from today, let the petitioners above named be released on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Madhepura P.S. Case NO. 598 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. with condition
