JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Laxmipur P.S. Case No. 50 of 2018, dated 17.02.2018, instituted for the offence punishable under Sections 302, 120(B) and 34 of the Indian Penal Code.

The informant is the brother of the deceased, who has alleged that the deceased has been killed by crushing his head with a stone.

During the course of investigation, it came to light that the deceased had earlier given loan to somebody at the instance of the petitioner and when that loan was not been returned, the deceased had taken money from

It has further come during the course of investigation that the deceased had some dispute with respect to payment for irrigating his field with one Jhama Yadav. The witnesses, who were examined during the course of investigation, have only stated that the deceased used to tell them that he suspected that perhaps the petitioner, his two brothers and aforesaid Jhama Yadav may harm him in future. On the basis of the aforesaid statement made to the relatives of the deceased, the petitioner has been arrested in this case. Beyond the aforesaid material and vague suspicion, there is no other evidence to connect the petitioner with the crime.

The petitioner is in custody since 13.03.2018 and does not have any criminal antecedent.

For the aforestated facts, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Jamui in connection with Laxmipur P.S.
