JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2019 The petitioner, who is in custody since 27.07.2019, seeks bail in connection with Dharhara P.S. Case No. 242 of 2018, dated 10.09.2018, instituted for the offences under Sections 25(1-B)a, 26 and 35 of the Arms Act. Two country made pistols and five live cartridges are said to have been recovered from the house of the petitioner.

It has been submitted on behalf of the petitioner that because of his tainted background, the aforesaid recovery has been thrust upon him and has been shown to have been recovered from a house which is in occupation of several persons.

Considering the facts aforestated, the petitioner above-named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Munger in connection with Dharhara P.S. Case No. 242 of 2018.

The application stands allowed.
