2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2) /132/ 303(2)/ 317(2)/ 317(4)/ 109/ 238/ 351(3)/ 49/ 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, petitioner and other accused persons managed to flee away with illegal sand loaded tractors.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no independent witness to the search and seizure and the witnesses are members of the raiding party.

5. Learned counsel for the State opposes the prayer

Patna High Court CR. MISC. No.1771 of 2025(2) dt.12-02-2025 2/2 for bail. He submits that there is specific allegation that the petitioner was involved in illegal sand mining and he has 17 criminal antecedents.

6. Considering the nature and gravity of allegation and the criminal antecedents, prayer for bail of the petitioner is rejected.
