In this case, the petitioners are apprehending their arrest in connection with Janta Bazar P.S. Case No. 22 of 2018 registered for offences under sections 341, 323, 324, 504, 506 & 34 of the Indian Penal Code and Section 3⁄4 of the Dayan Act. As per allegation made in the First Information Report, on 17.2.2008 at 8.30 AM, the Informant came out from the house, whereupon, the accused persons, namely, Basant Kumar Yadav, Jitendra Kumar Yadav and Smt. Sunita Devi started abusing her and other accused persons tried to eat her night soil for the reason that the son of Basant Kumar had died

Patna High Court Cr.Misc. No.26962 of 2018(2) dt.04-05-2018 2/2 due to snake bite and they used to abuse her in the name of Dian.

Learned counsel for the petitioners further submits that this is a counter case lodged by the petitioners and the petitioners have also received injury.

Looking to the entire facts and circumstances of the case as also the manner the victim has been treated by the accused persons, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected.

If the petitioners surrender before the court below and pray for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law. (Shivaji Pandey, J) rishi/- U T
