The petitioner is accused in connection with Special Case No. 9612 of 2019 arising out of Khushrupur P.S. Case No. 344 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.
The accusation is of recovery of 100 pouches each containing 200 ml country made liquor, kept in a sack, in front of the house of the petitioner.
Learned counsel for the petitioner submits that, in fact, petitioner is accused in similar nature of one case, i.e., Khushrupur P.S. Case No. 200 of 2019, in which, he is on bail due to that reason petitioner has falsely been implicated in the
Patna High Court CR. MISC. No.81276 of 2019(2) dt.18-12-2019 2/2 present case mere on suspicion, showing the recovery in front of the house of the petitioner. It is further submitted that in the present case, petitioner is in custody since 28.10.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise Act, Patna, in connection with Special Case No. 9612 of 2019 arising out of Khushrupur P.S.
