2. The petitioner is apprehending his arrest in Bhalpatti P.S. Case No. 59 of 2025 registered under Sections 191(2), 191(3), 190, 126(2), 127(2), 115(2), 118(1), 109, 324(A), 121(1), 121(2), 122(1), 352, 351(2) and 132 of BNS, 2023.
3. The prosecution case is that Rajmati Kumari alleged that her husband sold their 8-month-old son for Rs. 2,00,000/- to Laxmi Choupal, who later demanded ransom for returning the child. Acting on the complaint, the police recovered the child from Roshni Devi at Ahiyapur. While detaining the accused persons, a violent mob attacked the police, injured PTC Randhir Kumar, attempted to snatch his pistol and to get freed the
Patna High Court CR. MISC. No.86964 of 2025(2) dt.12-12-2025 2/3 accused. The police fired two rounds in the air in self-defence, as a result of which, the mob dispersed and child was secured. Altogether 32 named accused persons and 40-50 unknown individuals were found involved in the kidnapping, ransom of demand and assault on the police.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that there is general and omnibus allegation of causing obstruction in discharge of duty against the petitioner, other named accused persons and 40-50 unknown accused persons. He has next submitted that other co-accused persons have been granted anticipatory bail on similar grounds and the case of this petitioner is on better footing to that of the co-accused Laxmi Chaupal, who has also been granted anticipatory bail, by the co-ordinate bench of this court in Cr. Misc. No. 76053 of 2025 vide order dated 26-11-2025.
5. Learned APP for the State has opposed the prayer for anticipatory bail.
6. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
