====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-12-2025 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Maner Police Station Case No. 111 of 2022, disclosing offences under Section 30(a) of Bihar Prohibition and Excise Act.

3. The prosecution case, as per the First Information Report, is that on 07.02.2022, police received secret information that petitioner is engaged in the business of illicit country-made liquor. To verify the same, the police reached at the place of occurrence, saw that some persons were unloading the boat and loading the same on a Tempo. On seeing the raiding team, managed to escape after

Patna High Court CR. MISC. No.86402 of 2025(2) dt.23-12-2025 2/3 attempting to chase. On search, total 150 litres of illicit country-made liquor was recovered from the Tempo bearing Registration No. BR0PM-7690.

4. Learned Counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Recovery has been made from the boat which is an open space, accessible to all and sundry and also from the Tempo bearing Registration No. BR0PM-7690, which does not belong to the petitioner. Nothing has been recovered from the conscious possession and/or vehicle belonging to the petitioner. Petitioner is having clean antecedent.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that nothing has been recovered from the conscious possession and/or vehicle belonging to the petitioner and petitioner is having clean antecedent, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.
