JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-05-2018 The petitioner is apprehending his arrest in connection with Lakhisarai P.S. Case No. 488 of 2014 registered for offences punishable under Sections 143, 186, 352, 504, 506 and 290 of the Indian Penal Code.

Allegation against the petitioner is of raising slogans against police administration, forming unlawful assembly, pelting stones and also he obstructed the police officials in discharging their duties.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed against the petitionerand Large number of persons have been made accused and some of them have been allowed anticipatory bail by this Court. Learned APP has submitted that this is the case of the

Patna High Court Cr.Misc. No.27810 of 2018 (2) dt.15-05-2018 2/2 year 2014, but the petitioner has come for anticipatory bail after about four years.

In view of the nature of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner and it is, accordingly, rejected.

However, considering the facts and circumstances as detailed in the present application, let the petitioner surrender in the court below and the court below shall consider the case of the petitioner on its own merit and may grant regular bail without being prejudiced by this order on same day.
