JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in Phulwarisharif P.S. Case No. 694/2017 registered under Sections 304(B) and 34 of the Indian Penal Code.
The petitioner is said to have committed murder of the daughter of the informant over demand of money in association with his family members.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. It is not a case of dowry death as
Patna High Court Cr.Misc. No.28819 of 2018 (3) dt.24-05-2018 2/2 the deceased has died beyond seven years of her marriage. The I.O. has reported that he pushed open the closed door and found the dead body of the deceased hanging from the ceiling. The police have also submitted charge-sheet under Section 306 of the Indian Penal Code. Own sister of the deceased who is residing in the same house has stated that the deceased has committed suicide due to some domestic feud and there is no role of the petitioner in the aforesaid occurrence. The petitioner has been languishing in custody since 04.11.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge XVcum-A.C.J.M., Patna in connection with Phulwarisharif P.S. Case No. 694/2017.
