JUSTICE BIRENDRA KUMAR ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354(B)(D),341/34 of the Indian Penal Code and 8 of POCSO Act.

Four person allegedly committed offence of sexual assault against a minor girl. One of the four was apprehended by the villagers and he disclosed name of the coculprits which includes name of the petitioner also. In the aforesaid circumstance, identification of the petitioner by the victim is necessary. Hence, this is not a fit case for grant of anticipatory bail. Accordingly, prayer is refused

Patna High Court CR. MISC. No.81361 of 2019(2) dt.18-12-2019 2/2 in connection with Mahila (Naugachiya) P.S.Case No.66 of 2018 pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Bhagalpur. Petitioner may surrender and pray for regular bail.
