JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 Since both these cases arise out of Mirganj P.S. Case No. 71 of 2018, they have been taken up together and are being disposed of by this common order.

The petitioners seek bail in connection with Mirganj P.S. Case No. 71 of 2018, dated 12.03.2018, instituted for the offences punishable under Sections 414 and 34 of the Indian Penal Code.

The First Information Report reveals that while the informant/police officer was on patrolling duty, he found that three persons had congregated at a place in a suspicious circumstance. On seeing the informant, the aforesaid three persons tried to run away in three different directions. However, all of them were arrested. A motorcycle also was parked at the place where the aforesaid three persons were found standing. No document with respect to the vehicle could be given by anyone of them. As a result, the informant thought the vehicle was a stolen one and lodged the present First Information Report.

Learned counsel for the petitioners has submitted that they have got no concern with the motorcycle and only because they were found running away from the place of

The petitioners have clean antecedents and it appears that they have wrongly been made accused in this case.

They are in custody since 13.03.2018.

For the facts stated above, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XVI, Gopalganj in connection with Mirganj P.S.
