1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail arises out of Kudra Police Station Case No. 337 of 2022, dated 30.11.2022, disclosing offence under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018 (hereinafter referred to as 'the Act').

3. That the prosecution case, as per First Information Report, is that on 30.11.2022, the police received information that illicit liquor was being transported by a grey coloured car. Consequently, during vehicle checking, a grey coloured car was intercepted and upon chase, two persons were arrested who disclosed their names as Vinay

Patna High Court CR. MISC. No.86032 of 2025(2) dt.22-12-2025 2/3 Yadav and Surya Prakash Yadav, and further disclosed the name of Ajay Yadav (petitioner) and Chhotelal Yadav. Upon search, 71.280 litres of country-made liquor was recovered from the Hyundai Centro car bearing registration no. UP70-AC-7999.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case on the basis of confessional statement made by arrested co-accused Vinay Yadav, who was the driver of the vehicle. He next submits that the car, in question, does not belong to the petitioner and illicit liquor has not been recovered from conscious possession of the petitioner and/or from the vehicle belonging to him.

5. Regards being had to the submission advanced by learned counsel for the parties and taking into consideration the fact that the petitioner is not the owner of the vehicle from where illicit liquor has been recovered, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/-

No.86032 of 2025(2) dt.22-12-2025 3/3 (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge I, Kaimur at Bhabua, in connection with Kudra Police Station Case No. 337 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
