2. The petitioner seeks pre-arrest bail in connection with Khajekalan P.S. Case No. 443/2025 registered for the offence(s) punishable under Section 30(a)of the Bihar Prohibition and Excise Act.

3. As per the allegation made in the FIR, 105 litres of illicit liquor was recovered from a Khatal, allegedly belonging to the petitioner.

4. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail. Referring to paragraph no.3 of the bail application, he submitted that petitioner has 5 criminal antecedents, out of which three under Excise Act.

5. Considering the past antecedents of the petitioner,

Patna High Court CR. MISC. No.86028 of 2025(2) dt.18-12-2025 2/2 I am not inclined to grant pre-arrest bail to the petitioner.

6. However, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail. In that case, the learned District Court is directed to consider the bail application of the petitioner on the same day and pass necessary order on the basis of material which has come in course of investigation without delay.

7. The present petition stands disposed of.
