1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barbigha P.S. Case no.259 of 2019 registered under section 379 of the Indian Penal Code.

3. As per the prosecution case, the motorcycle of the informant was stolen by unknown accused persons. The informant states that the act of theft has been captured in the CCTV footage.

4. Learned counsel for the petitioner submits that F.I.R. was registered against unknown. Referring to the order of learned trial Court, it is submitted that no material has transpired in course of investigation to connect the petitioner with the

Patna High Court CR. MISC. No.4277 of 2024(2) dt.31-01-2024 2/2 alleged crime. The prosecution is mainly relying on the antecedents of the petitioner. No incriminating article has been recovered from his possession. Inspite of being in custody since 1.4.2023, the petitioner has not been put on T.I. parade and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made, no incriminating article having been recovered from the petitioner's possession, his being in custody for more than 9 months since 1.4.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Barbigha P.S. Case no.259 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sheikhpura.
