This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 17.04.2018 by the learned 1st Additional Sessions Judge-cum-Special Judge, (POCSO), Aurangabad in connection with Kasma P.S.Case No. 22 of 2018 registered under Sections 354(A)(i)(ii) of the Indian Penal Code, under Sections 3(i)(r)/3(i)(w)(i)/3(2)(v)(a)of the Scheduled Castes and Scheduled Tribes Act and Section 8 of POCSO Act. Considering the nature of allegation in the FIR which is supported by the victim girl in her statement under Section 161 Cr.P.C., prima facie, serious allegation is disclosed

Patna High Court CR. APP (SJ) No.1596 of 2018 dt.17-07-2018 2/2 against the appellant. Hence, I do not find any merit in the submission of learned counsel for the appellant that the FIR was lodged after delay of 10 days and for that reason, FIR is not believable.
