Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Pusa PS case no. 113 of 2024, disclosing offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The prosecution story, as per the First Information report, is that total 436.185 liters of illicit foreign liquor has been recovered from the mango orchard of Sanjeev Choudhary and accordingly, seizure list was prepared.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case by the local chowkidar due to previous enmity. He further submits that petitioner has no concern either with the mango orchard of

Patna High Court CR. MISC. No.480 of 2025(2) dt.06-02-2025 2/2 Sanjeev Chaudhary or with the seized illicit liquor. He also submits that though petitioner is accused in one another case but it is not of the similar nature of offence.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that illicit liquor has been recovered from the mango orchard, which is an open space, accessible to all and sundry as also the fact that petitioner has no criminal antecedent of the similar nature of offence, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise- I, Samastipur in connection with Pusa PS case no. 113 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
