JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.2.2018, seeks bail in Kotwa PS Case No. 202 of 2017 registered under Sections 302 and 201/34 of the IPC.
The allegation in brief is that brother-in-law of the informant informed him that his sister is serious and when he reached in the village found some persons including the petitioner standing by the side of dead body where cremation was being held and it is alleged that Mamta Devi and Prince Jha after killing his sister were disposing her dead body.
Learned Counsel for the petitioner submits that the petitioner is a distant agnate of husband of the deceased, she died natural death where after they were cremating the dead body where he was also present, family members Mamta Devi and Prince, sister-in-law and nephew of the deceased, against whom allegation is of killing and disposing of the dead body, have been granted anticipatory bail vide Cr. Misc. No. 10802 of 2018.
Having considered the said facts and circumstances, the petitioner, namely, Malik Ojha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Motihari East Champaran in connection with Kotwa PS Case No. 202 of 2017.
