2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that the F.I.R. named accused persons, including this petitioner, have indiscriminately opened fire upon the brother of the informant, namely Ravindra Kumar Yadav, as a result of which he died.
4. It is submitted by learned counsel appearing on behalf of the petitioner has falsely been implicated in this case. It is next submitted that the name of this petitioner has transpired in this case during course of investigation and he is not involved in the alleged occurrence. The petitioner is in custody since 20.07.2023.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner and submitted that during course of investigation it has come that this petitioner is a contract killer and has also got two criminal antecedents. It is further submitted that prayer for grant of bail of co-accused Vijay Ram, having similar allegations, has already been rejected by a Co-ordinate Bench of this Hon'ble Court vide order dated 31.01.2024 passed in Cr. Misc. No.3153 of 2024.

Considering the rival submissions, criminal antecedents of the petitioner and the fact that prayer for bail of similarly situated co-accused person, namely Vijay Ram, has already been rejected by a Co-ordinate Bench of this Court, the prayer for grant of bail of this petitioner is rejected.
