JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.5.2017, seeks bail in Sherghaty PS Case No. 223 of 2017 registered under Sections 399, 402, 411, 413, 414 of the IPC and Sections 26(1-B)a, 26, 35 of the Arms Act.

The allegation in brief is that the police apprehended number of miscreants, one knife was recovered from the possession of the petitioner and other arms were also recovered from other accused persons who are alleged to have been planning for committing dacoity.

Learned Counsel for the petitioner submits that prior to institution of the present case the petitioner had no criminal antecedent and only subsequent to lodging of the present case he has been remanded in three other cases.

Having considered the aforesaid facts and recovery of only a knife from his possession, the petitioner, namely, Md. Irfan Khan @ Akhtar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Sherghaty, Gaya in connection with Sherghaty PS Case No. 223 of 2017.
