JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-05-2018 The petitioner, by way of the present writ petition, has challenged the order of suspension dated 16.10.2015 as well as has prayed for issuance of direction to the respondents to pay the subsistence allowance.
The learned counsel for the parties are in agreement that the present case can be disposed of with a direction to the disciplinary authority to dispose of the pending departmental proceedings and pass a final order within a period of six months from today, failing which, the suspension order shall stand revoked automatically.
In view of the said agreement between the parties, this Court directs that the departmental proceedings be completed
Patna High Court CWJC No.9290 of 2018 (2) dt.14-05-2018 2/2 within a period of six months from today and the final order be passed within the same period, failing which, the order of suspension shall stand revoked automatically. It goes without saying that the outstanding amount of subsistence allowance should be paid to the petitioner within a period of four weeks from today.
The writ petition is disposed of on the aforesaid terms.
