2. The petitioner seeks bail in connection with Mohammadpur P.S. Case No. 231 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, 660 liters of illicit liquor has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case and nothing has been recovered from his conscious possession.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 03.11.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts and the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise-I, Gopalganj in connection with Mohammadpur P.S. Case No. 231 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Mohammadpur Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
