2. The petitioner has preferred this application for grant of regular bail in connection with Bajpatti P.S. Case No. 195/2024 dated 10.07.2024 registered for the offence punishable u/s 316(5), 318(4) and 61(2) of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have deposited customer's money in their personal account. It is further alleged that on the basis of 17 written complaints a primary inquiry was conducted and it was found that all the accused persons misappropriated Rs. 16,25,500/- and further alleged that Sangeeta Singh, Gopal Jha and Indrajit Kumar have misused their respective position as

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The other co-accused person has already been granted anticipatory bail by the Co-ordinate Bench vide order dated 04.03.2025 passed in Cr. Misc. No. 7822/2025. The petitioner is posted in Belahiya post office as GDS and has no concern from sub-post office, Bajappati and has not committed any misconduct and misappropriation. Learned counsel has submitted that the main accused of this case is Gopal Jha, who was posted as Post Master in Bajpatti sub-post office. The petitioner has been remanded in this case from Bajpatti P.S. Case No. 132/2024. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.08.2024

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of

Patna High Court CR. MISC. No.89103 of 2024(4) dt.06-05-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Pupri at Sitamarhi in connection with Bajpatti P.S. Case No. 195/2024, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. (ii). The petitioner is directed to co-operate during the trial.
