The petitioner seeks bail in connection with Excise Case No.968 of 2019, arising out of Kinjar P.S. Case No.96 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The accusation is that three persons were seen, borne on one motorcycle. On seeing the police party, they started to flee away, leaving the motorcycle. While they were chased but they succeeded to flee away. The local Chowkidar identified the aforesaid three persons including the petitioner. On search of the motorcycle, 32 bottles, each containing 375 ml. Indian Made Foreign Liquor, were recovered.

Patna High Court CR. MISC. No.83156 of 2019(2) dt.16-01-2020 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is not the owner of the seized motorcycle. Due to dirty village politics, the name of the petitioner and others has been disclosed by the local Chowkidar. The petitioner is in custody since18.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Jehanabad, in connection with Excise Case No.968 of 2019, arising out of Kinjar P.S.
