Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Aayar PS case no. 118 of 2023, disclosing offences punishable under Sections 354(B), 307 and other allied sections of the Indian Penal Code.

The prosecution story, as per the First Information report, is that on 10.09.2023, in the morning, when the daughter of the informant had gone to market for purchasing some articles, then co-accused Chand Thakur misbehaved with her, which was objected by the informant's daughter. It has further been alleged that the accused persons entered into the house of the informant and co-accused Chand Thakur pulled down the informant's wife on the ground and assaulted her causing head
Patna High Court CR. MISC. No.63 of 2024(2) dt.24-01-2024 2/3 injury etc. Co-accused Ramesh Thakur pulled informant's daughter by her hair and also assaulted her.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case along with his family members due to land dispute between the parties. It is further submitted that a title suit bearing Title Suit no. 176 of 2015 is pending between the parties pertaining to a piece of land. It is next submitted that injuries caused to the informant's wife are simple in nature.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that both parties have land dispute between them and injuries caused to the informant's wife are simple in nature and a Title Suit is pending between them, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Bhojpur at Ara in connection with Aayar PS case no. 118 of 2023, subject to the
Patna High Court CR. MISC. No.63 of 2024(2) dt.24-01-2024 3/3 condition laid down under Section 438 (2) of the Code of Criminal Procedure.
