Petitioner, already in custody, seeks bail in connection with Baruraj P.S. Case No.180 of 2017 registered under Section 395 of the Indian Penal Code.

Allegation in brief is that 30-35 dacoits committed dacoity in the house of the informant and looted cash, jewelleries and also looted several mobiles of the inmates of the house and later on during investigation police recovered two mobiles with one country made loaded pistol from possession of the petitioner.

Learned counsel for the petitioner submits that there is no recovery from possession of the petitioner; whereas learned counsel for the State refers paragraph-66 of the case diary

Patna High Court Cr.Misc. No.29472 of 2018(3) dt.29-06-2018 2/2 showing recovery of country made loaded pistol and two looted mobiles from possession of the petitioner and also refers paragraph-113 showing two criminal antecedents of the petitioner.

Having considered the aforesaid facts and circumstances, in particular recovery of the looted articles, prayer of bail of the petitioner is rejected. (Arun Kumar, J) S.KUMAR/- U T
